Introduction

These Terms and Conditions (the "Terms") govern the consumption costs generated through proof of concept offerings to HybrIT customers, specifically concerning Microsoft Azure and Microsoft licensing. By engaging with HybrIT for these services, the customer agrees to abide by these Terms. HybrIT reserves the right to modify these Terms, and the latest version will always be available on our website within our Document Library. It is the customer's responsibility to review these Terms regularly.

Consumption Costs Responsibility

The customer acknowledges that any consumption costs associated with Microsoft Azure and Microsoft licensing incurred during the proof of concept (POC) are their responsibility. HybrIT will provide the necessary services and resources for the POC, but all costs associated with the usage of Microsoft services are to be borne by the customer.

Credits and Incentives

HybrIT may, at its discretion, offer credits or incentives towards the consumption costs as a part of the proof of concept offering. These credits may be sourced from Microsoft or through distribution partnerships. The availability and amount of such credits or incentives will be communicated to the customer before the commencement of the POC.

Cloud Account Setup

Unless agreed otherwise, HybrIT will set up a cloud account on behalf of the customer to facilitate the consumption of Microsoft services during the proof of concept. The customer is responsible for ensuring that this cloud account is used only for the purposes of the POC, and any unauthorised usage or activities will be the customer's responsibility.

Invoicing and Payment Terms

The invoicing and payment terms for consumption costs during the proof of concept will follow our standard Procurement Terms and Conditions. Customers are required to adhere to the payment terms specified in that document.

Data and Privacy

HybrIT takes data privacy and security seriously. During the POC, certain data may be collected to facilitate the setup and management of the cloud account and services. The customer acknowledges and consents to the collection and processing of such data as outlined in our Privacy Policy.

Termination

If either party wishes to terminate the POC, it should be done in accordance with the termination provisions outlined in the standard Procurement Terms and Conditions.

Changes to Terms

HybrIT reserves the right to modify these Terms as deemed necessary. Any changes will be communicated to the customer, and the latest version of the Terms will be available on our website. Continued engagement with HybrIT's services implies acceptance of these updated Terms.

By engaging with HybrIT for proof of concept offerings related to Microsoft Azure and Microsoft licensing, the customer agrees to adhere to these Terms and the referenced standard procurement terms and conditions. It is essential for customers to review both sets of terms and conditions to ensure a clear understanding of their rights and obligations.
